F. & C.C. Misused in Bold Case of Thievery at Black Bell on Beacon Hill

??? Martin and Charles Leavey were yesterday arrested, arraigned, bound over to the district court, and taken to the county jail at Colorado Springs, charged with a robbery committed no longer ago than Saturday night.
The robbery was one of the most brazen that has ever been perpetrated in this land of hold-ups and ore thieves.
The thieves first went to the Florence & Cripple Creek agent at Anaconda and chartered a car, No. 4219, and had it left on the siding at Beacon hill. Then, on Saturday night, they went to Victor and got a four-horse team and an ore wagon.
They drove to Beacon hill, to the lease of Pentland, Price, Miller and McLeod, on the Black Bell. They drove boldly up to the ore house and opened it, and began shoveling in the ore.
Two men, named Williams and Bell, occupy a cabin on the Black Bell, and heard the noise made by shoveling the ore. They started out to see what it meant, but were confronted by a man with a Winchester, who advised them to get back inside and stay there.
They got.
He stood guard while his companions loaded the ore and drove off, and kept Williams and Bell in the cabin until nearly daylight.
Sunday morning the lessees found themselves short nearly four tons of ore valued at $100 a ton. They took the wagon trail and easily traced it to the siding at Beacon hill, where they found and recognized their ore, which was piled in with about 11 tons more, which the industrious thieves had stolen from somewhere else to fill out their car.
They at once notified the Florence & Cripple Creek people not to move the car, and to notify the officers if anyone applied to have it billed out.
The car stood on the track all day Sunday, but about 10 o'clock Sunday night three fellows appeared at the station and wanted the car billed. The agent refused, on the ground it was Sunday, and they skipped out over the hills, eluding the officers.
Night Marshall Morgan of Anaconda, went vigorously in chase of the thieves, and finally came to the conclusion that he had located them in a cabin near the head of Eclipse gulch, below the Moose mine.
He and his companions found the door locked with a chain, but they drew the staple and rushed into the room.
The fellows inside had been asleep until the moment that rush was made. They found Martin and Leavey in bed, and Horn under the bed, where he had hidden when he heard the officers entering.
It was well for Morgan and his men that they had been asleep, for they had four guns in the room.
They were taken to the Anaconda jail, and yesterday were arraigned before Squire Smith. They waived examination and were placed under bonds of $500 each, and being unable to give bond, were taken to Colorado Springs last night.
Yesterday the officers went after the man who owns the team, and the driver who was on the wagon when the ore was hauled away.
Last evening Marshal Lee Martin of Anaconda went over Victor and arrested the owner and the driver, who are thought to have been implicated in the matter.
Horn, who is thought to have been the ringleader in the affair, is well known to the police of the district. The officers say he is the same who who was last fall arrested and jailed on a loathsome charge.
The others, Martin and Leavey, are lads only about 17 or 18 years of age. They used to hang about Anaconda, but have not been seen there for nearly a year until this escapade brought them to notice.
The officers state that one or more of the men has squealed, and that it will be an easy matter to send the whole outfit up for it.
