W. P. H. Shipments Resumed
Shipping has been resumed at the W. P. H. mine, and a steady tonnage will be made from that Ironclad hill property. The extension of the rich ore shoot originally opened in the upper workings has been cut on the 500-ft. level, from which the consignment was made yesterday.
The vein at this depth measures from 3 to 4 ft. between walls, and carries values of from 1.5 to 2 oz. gold to the ton. A large amount of development work has recently been done in the W. P. H. and the shaft is now to a depth of 650 ft.

W. P. H. M. & L. Co. Still Erecting Mill
Cripple Creek, June 19. (Special Correspondence)—The W. P. H. M. & L. Co. is operating a lease on the west end of the W. P. H. claim. The shaft is down 350 ft., and over 2,000 ft. of drifts are open.
A. B. Whitmore, the superintendent, states they have a body of oxidized ore, that runs $6 to $9, that is over 200 ft. wide. The company is erecting a 100-ton mill for handling the ore from this mine, as well as working the dumps of the Jerry Johnson mine, on which they have a lease.
The mill is being constructed by Groch & Woodard, consulting engineers, of Cripple Creek. They have been delayed on account of deliveries of material, but hope to be running before August 1. The company has 15 acres in the lease.

W. P. H. Mine During 1904
The W. P. H., on Ironclad Hill, is a good illustration of the results of the leasing system in 1904. This lease, now expired, has been one of the notable shippers of the year, both in tonnage and in the remarkable tenor of the ore.
Prospecting was inspired by the temporary success of the Damon and Jerry Johnson several years ago, in territory adjoining to the south and in the same somewhat complex system of small intersecting fissures at or near the contact of the volcanic body of the district with the older granite.
It is also an additional suggestion that the richest ore deposits of Cripple Creek are usually found along the periphery of the volcano, where the country is most intricately fissured.
The W. H. P. produced in 1904 a higher average grade of ore than ever before mined from any single property in Cripple Creek during a similar period.

Colorado Springs, Sept. 8. One of the largest bodies of ore now being worked in the district is that which was encountered in the 325-foot level of the W. P. H. mine, belonging to the United Gold Mines Company located on Ironclad Hill.
In stoping the leasers are now breaking 18 feet of ore and only one wall has been located. About one-half of the rock that is broken is making screenings that give returns at the rate of $200 to the ton.

W. P. H. Lease Case at District Court
W. P. H. LITIGATION.

The District Court at Cripple Creek refused to order that five-eighths of the proceeds of the famous W. P. H. lease be paid into court pending the result of litigation started by Charles Wider.
Wider's claim, briefly stated, is to the effect that he entered into an equal one-third co-partnership with Seiver and Harrison, August, 1902; that, by the terms of the agreement, which was not reduced to writing, each was to share alike in all transactions entered into by any of the partners; that Wider stood his share of the cost of certain lawsuits in which the Jerry Johnson lease and others became involved; that he was forced to leave for New Mexico and Arizona on account of ill health, and that while there he remained faithful to his partners, causing them to share alike with him in all property acquired in those states.
It is further affirmed by Wider and his attorney that his alleged partners discovered that the ore shoot from the Jerry Johnson dipped into the W. P. H. and that they deceitfully concealed that fact from him.
In support of the case of the defendants, their attorney urged before the District Court that the plaintiff had plainly stated himself out of court. The co-partnership was admitted to have been one at will, and was plainly terminated by the dissent of any of the parties thereto. All the parties must have engaged in actual mining operations, continuously, whereas it was admitted by the plaintiff that he left the camp and remained away for a period of nine months.

A consignment of ore sent out by the lessees will return in round figures, $80,000 for the single day's shipment. The ore was sent to the Eagle sampler and runs about as follows:

fourth grade, ten and one-half tons, worth about $500 per ton.

Several finds of more than usual importance were recorded during the past week, the richest of which is perhaps that one made on the W. P. H. claim, belonging to the United Gold Mines Company on Ironclad hill. The lessees on this claim recently broke into an ore shoot, the richness of which goes far beyond the highest dream of mining men.
A vein of ore running $500 per ton in gold was uncovered, in the center of which is a streak two feet in width that assays 65 per cent. pure gold. Immediately after the strike was made the lessees gouged out $16,000 in two hours.
Twenty additional assays were taken all of which show values of from $43,000 to $100,00 per ton.

W. P. H. Phenomenal Ore Discovery
W. P. H.—Lessees on a block of ground in this mine have struck a phenomenal body of ore. Possibly no richer bunch of ore was ever found in the district. The ore was found in the 250-foot level. A shipment of a few tons is said to have realized $25,000 net. Samples taken from a width of about eighteen inches gave the following:

The lease was originally secured by the Mueller brothers on April 18th of last year and covers a period of two years from that date. At that time there was nothing but an old shaft fifty feet deep on the ground.
These lessees in turn transferred the lease to Attorney Crump, who, in turn, transferred it to Harrison & Seaver, leaving the Mueller boys one-quarter and Attorney Crump a one-eighth interest.
The lessees sunk the shaft 200 feet deeper and did considerable work without getting an assay above $7 until December 23d, when the first pay values were encountered. The mine closed for the holidays, December 24th, 25th and 26th, and on the 27th the lessees, working at a point about 100 feet west of the shaft, shot into the rich ore.
Fearing annoyance and theft, very little was said about the discovery, and for the first time to-day the newspaper men were permitted to view the strike and given the full particulars.
There is one sad feature to the story of the discovery. On December 9th one of the Mueller brothers, the original lessees, was mangled and instantly killed by an explosion caused by picking a missed shot. At that time the unfortunate miner was working within a few feet of the bonanza which was to bring fortunes to his relatives and associates. His interest is now held by his brother.
