Portland.—The company has been made defendant in an apex suit, in which it will be alleged that $500,000 worth of ore has been wrongfully extracted from the F. & C. C.F. C. C. property, which is located in the center of the Portland estate, and is claimed by the Portland company as a portion of its Captain lode.
The instituting of this suit will bring up the matter of title to the property.

N. L. Shaffer vs. Portland Gold Mining Co.—This suit has been filed in the United States Circuit Court at Denver for $550,000 and interest. Plaintiff alleges that the amount is to compensate for alleged infringement of his apex rights to gold and silver-bearing veins in the F. C. C. lode in the Cripple Creek district.
The F. C. C. fraction is in the southeast corner of the Portland estate, and plaintiff alleges that he has developed thereon a vein apexing within the surface boundaries of this claim.
The ore wrongfully extracted by the Portland from continuation of this vein is valued at $250,000.

Portland Gold Mining Company vs. Edward L. Schaffer Case
Portland Gold Mining Company vs. Edward L. Schaffer.—A petition in intervention in this case has been filed in the District Court of Cripple Creek, Colorado, the intervenors being lessees on the F. and C. C. claim. The intervenors cite that it was agreed between them and Schaffer that if the property was sold for $30,000 within six months, lessees were to receive a commission of 20% of the sale price. If it was not sold, lessees were to purchase the same, making installment payments.
It is now alleged that the Portland company has taken $50,000 in ore out of the leased property, and has prevented them from mining $200,000 more. Judgment is asked in the amount of $250,000, and a temporary injunction prayed preventing the company from molesting the lessees.

A two-thirds interest in the F. C. C. claim has been deeded to C. T. Fertig. This is a fraction surrounded by the Portland mine, and is the subject of a lawsuit for heavy damage for trespass by the Portland Gold Mining Co.
